Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and PolitiMind, Inc. ("PolitiMind"). By creating an account or accessing the Services, you accept these Terms, the Privacy Policy, the Acceptable Use Policy, the Participant Rewards & Payments Terms, and the Platform & Token Risk Disclosures, each incorporated by reference. Account signup records your acceptance with a timestamp and document version. If you do not agree, do not use the Services.

You must be (a) at least 18 years old, (b) a United States resident with a valid government-issued ID, and (c) not located in a jurisdiction subject to U.S. sanctions or listed on any prohibited-persons list. PolitiMind may restrict access based on geolocation, device signals, or verification outcome.

Each individual may maintain only one verified account. You must provide accurate information, complete identity verification, and keep your credentials secure. You are responsible for all activity under your account.

Subject to these Terms, PolitiMind grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for lawful, personal, non-commercial civic purposes.

You retain ownership of content you submit. You grant PolitiMind a worldwide, royalty-free, sublicensable license to host, reproduce, display, and create aggregated/anonymized derivatives solely to operate, improve, and report on the Services and civic intelligence outputs.

Eligible paid studies may state a USD-denominated reward before participation. The amount is based on estimated completion time and qualification requirements, never on the political content of an answer. Submission does not itself make funds available: a reward may remain pending during qualification and integrity review.

Available payout methods, thresholds, review states, and timing are capability-gated and shown in-product. PolitiMind does not guarantee study availability, eligibility, qualification, income, or payout timing. Additional terms are in the Participant Rewards & Payments Terms.

$PMIND is a planned future participation utility. It has not launched, is not required to use PolitiMind, and is not represented as a current participant payout method.

If introduced, separate launch terms and disclosures will govern availability, network, custody, transferability, and risk. PolitiMind makes no representation regarding future value, liquidity, exchange listing, or convertibility into fiat.

PolitiMind may in the future support non-transferable, on-chain participation receipts. No such receipt conveys governance, financial, or voting rights outside the PolitiMind platform. Availability will be stated explicitly if and when the capability launches.

The Services are not a wagering, prediction-market, gambling, or betting service. Poll participation is for civic-intelligence purposes only. Any contest, sweepstakes, or reward feature is governed by the Participant Rewards & Payments Terms or separate official rules published with that feature.

Use of the Services is subject to our Acceptable Use Policy, which is incorporated by reference. Prohibited conduct includes vote manipulation, sybil attacks, VPN/geo-spoofing, scraping, harassment, election interference, and exploitation of smart contracts or the neutrality-audited AI layer.

PolitiMind, the PolitiMind marks, the platform, and all related software, models, datasets, scoring methodologies, and content are owned by PolitiMind, Inc. or its licensors and protected by intellectual-property law. No rights are granted except as expressly stated.

AI-assisted features pass through our neutrality-audited AI layer with bias scoring and audit logging. Outputs are informational, may contain inaccuracies, and do not constitute legal, financial, medical, or political advice. You are responsible for verifying outputs before relying on them.

The Services interoperate with third parties (Base, wallet providers, identity vendors, CMS, analytics). PolitiMind is not responsible for third-party services and their terms apply to your use of them.

PolitiMind may suspend or terminate access for violation of these Terms, suspected fraud, manipulation, regulatory requirement, or risk to the Services. Sections that by their nature survive termination shall survive.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. POLITIMIND DOES NOT WARRANT THE OUTCOME, ACCURACY, OR PREDICTIVE VALUE OF ANY POLL, SCORE, OR AI OUTPUT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLITIMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, TOKENS, OR GOODWILL. POLITIMIND'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) AMOUNTS PAID BY YOU TO POLITIMIND IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

You will defend, indemnify, and hold harmless PolitiMind, Inc. from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Services, your content, or your breach of these Terms or applicable law.

Any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA), Commercial Arbitration Rules, seated in Wilmington, Delaware, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class-Action Waiver. You and PolitiMind agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

30-Day Opt-Out. You may opt out of this arbitration agreement by emailing chris@politimind.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out".

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

These Terms, together with the Privacy Policy, Acceptable Use Policy, and Token & Risk Disclosures, constitute the entire agreement between you and PolitiMind and supersede prior agreements. If any provision is unenforceable, it shall be modified to the minimum extent necessary and the remainder shall remain in effect. No waiver is implied by delay. Force majeure events excuse non-performance. You may not assign these Terms; PolitiMind may assign without restriction. We may modify these Terms upon notice; continued use constitutes acceptance.
